Learning Area 1: Fiqh
Subject: Uṣūl al-Fiqh (Islamic legal theory)

Focus: The concept of maṣlaḥah (public interest) in Islamic law

Textbook: Ḍawābiṭ al-Maṣlaḥah

Objective:
The concept of maṣlaḥah is engaged within the context of the legal philosophy of the Sharīʿah. It is compared against the utilitarianism of Mill and Bentham. After establishing the position of maṣlaḥah in the Sharīʿah, the mandatory parameters within which it operates, and the violation of which constitutes unwarranted use of maṣlaḥah, are clearly identified. An excursus deals with the status of the maṣlaḥah mursalah, in not just the Mālikī school, but all four schools.

Focus: The theory of maqāṣid al-Sharīʿah (higher objectives of Islamic law)

Textbook: Al-Muwāfaqāt fī Uṣul al-Sharīʿah

Author: al-Shāṭibī, Abū Isḥāq Ibrāhīm ibn Musā (d. 790/1388)

Objective:
The theory of maqāṣid is observed through a study of the third section of al-Shāṭibī’s Muwāfaqāt, in which he, following on the heels of al-Ghazālī and Ibn ʿAbd al-Salām, developed the theory. Together with imparting a sound understanding of the concept as developed by al-Shāṭibī, the module aims at detecting the motives behind contemporary departures from—if not distortions of—the original idea of maqāṣid.

Subject: Qawāʿid Fiqhiyyah (legal maxims)

Focus: The phenomenon of ashbāh and naẓʾir (parallelism and similitude) in Islamic law

Objective:
Following on the study of legal maxims in previous years, this module goes on to explore substantive fiqh in the cross-referenced, non-chapter specific approach that focuses upon parallelism and similitude between points or areas of fiqh. It seeks to nurture the acuity and keenness required for dealing with legal exigencies.

Focus: Contemporary Islamic finance and banking

Objective:
This module aims to create familiarity with the concepts, structures, literature and terminology of contemporary Islamic finance and banking against the backdrop of the classical disciplines of fiqh, uṣul al-fiqh and qawāʿid fiqhiyyah.







Learning Area 2: Qurʾān
Subject: Tafsīr cum ʿAqīdah

Focus: A diachronic study of the influence and relationship of ʿAqīdah in the Tafsīr literature

Textbook: Tafsīr Āyāt al-ʿAqīdah

Author: Ḥājī, ʿAbd al-ʿAzīz (d. H/CE)

Objective:
This contemporary seminal masterpiece has been incorporated into this module and serves a dual purpose. On the one hand it explores the development of Islamic creed, both historically and within the exegetical works. This displays a diachronic study of the role which Kalām (scholasticism) played within the understanding of the Qurʾān. On the other hand it seeks to anchor the fundamentals of the Islāmic creed within the texts of the Qurʾān and Sunnah. The work also explores the contributions of exegetes from various Islamic theological ideologies and sheds light on their hermeneutics within the theological subject matter of the Qurʾān.

Focus: A reading of the canonical ḥadīth texts focusing on both mutūn and asānīd
